Distance Sales Agreement
Last updated: 16 September 2026
This Distance Sales Agreement is made under Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation. Package tours fall outside the scope of the Distance Contracts Regulation; for tour sales, the Package Tour Contracts Regulation also applies.
1. Parties
Seller: Markention Dijital Pazarlama San. ve Tic. Ltd. Şti. (RotaNur brand)
Address: Cevizli Mah. Zuhal Cad. Ritim İstanbul A5 Blok No:46E/179, 34846 Maltepe / Istanbul, Türkiye
Tax: Kartal Tax Office, tax ID 6121767816
Phone: +90 534 021 47 45 · Email: info@rotanur.com
Buyer: The consumer whose name, contact details and, for product orders, delivery address appear in the reservation or order request form.
2. Subject
This agreement sets out the rights and obligations of the parties for the sale and performance of the tour service or product that the Buyer requests on the Seller’s site rotanur.com and that the Seller confirms.
3. Formation of the agreement
A reservation or order request sent on the site creates no obligation to pay. After receiving the request, the Seller contacts the Buyer and confirms the product or service, the total price including all taxes, the delivery or performance and the payment details. The agreement is formed when these details are confirmed and the Buyer approves them. Before the agreement is formed, the Buyer receives the Preliminary Information Form. The Preliminary Information Form and the Cancellation & Refund terms are an integral part of this agreement.
4. Product, price and payment
The essential features of the product or service are shown on the product page; its type, quantity and sale price including all taxes are shown in the request summary. For tour services, the price depends on the chosen date, departure point and room type; the final price is written in the contract and can change only in the cases and under the conditions allowed by law. No delivery fee is charged for physical products.
No online payment is taken on the site. Payment is made using the method and schedule the Seller gives the Buyer after the reservation or order request. Any deposit and payment schedule are given to the Buyer in writing before payment.
5. Delivery and performance
- Tour services: There is no physical shipment. The Buyer is told on the same day that the booking is confirmed. The service is performed on the dates in the tour programme.
- Physical products: Products are delivered to the address in Türkiye given by the Buyer within 3 business days at the latest after the order is confirmed. No shipping fee is charged. If the parcel looks damaged, the Buyer asks the courier to record it on delivery and informs the Seller.
6. Right of withdrawal
For physical products, the Buyer can withdraw from the agreement within 14 days of the day the product is received, without giving any reason and without paying a penalty. Notice of withdrawal is given before the period ends by email to info@rotanur.com, by a written WhatsApp message or in writing to the Seller’s address. The Buyer sends the product back within 10 days of the notice using the courier named by the Seller; no return shipping fee is charged. Within 14 days of receiving the notice, the Seller refunds the total amount paid in one go, in a way that matches the payment method, without charging the Buyer any cost.
Under Article 15 of the Distance Contracts Regulation, the right of withdrawal does not apply to products whose protective packaging has been opened after delivery and whose return is not suitable for health and hygiene reasons, products that can deteriorate quickly or pass their expiry date, or products prepared specially at the Buyer’s request. Examples are given in the Cancellation & Refund terms. Because package tours are outside the scope of that Regulation, there is no 14-day right of withdrawal for tour services.
7. Cancellation and transfer of tour services
The Buyer can terminate the package tour contract by giving notice in writing or on a durable medium. If the Buyer cancels at least 30 days before the tour starts, nothing is deducted except taxes, duties and similar statutory costs, and the amount paid is refunded. If the Buyer cancels less than 30 days before the tour starts, only the amount or rate set out in advance in the contract may be deducted. If the cancellation results from an unforeseeable situation or force majeure, only statutory costs and documented, non-refundable amounts paid to third parties are deducted. Refunds are made within 14 days of the date the cancellation reaches the Seller.
The Buyer can transfer the contract to another person who meets the tour conditions by notifying the Seller at least 7 days before the tour starts. If an essential feature of the tour changes significantly or the Seller cancels the tour, the Buyer’s rights under the Package Tour Contracts Regulation are reserved. For hajj, the registration and refund rules of the Presidency of Religious Affairs (Diyanet) also apply.
8. Defective products and services
If a product or service is defective, the Buyer can use the remedies in Articles 11 and 15 of Law No. 6502. The Seller bears the shipping costs of defective products.
9. Personal data
The Buyer’s personal data is processed as explained in the Privacy Policy and the Data Protection (KVKK) Notice.
10. Disputes
The Buyer can send requests and complaints to the Seller’s contact details above. In a dispute, the Buyer can apply to the consumer arbitration committee where the Buyer lives or where the transaction took place, within the monetary limits set each year by the Ministry of Trade, or to the consumer court for disputes above those limits.
11. Entry into force
This agreement enters into force when it is formed as described in Section 3. A copy of the agreement and the Preliminary Information Form is sent to the Buyer by email.
